These Terms of Service ("Terms") govern your use of the Sparks mobile application ("Sparks" or the "App") operated by Oleksandr Korzh ("we", "us", or "our"). By downloading, accessing, or using Sparks, you agree to these Terms.
Sparks is a creativity and idea-development app. Depending on the version of the App and your subscription status, Sparks may let you:
You must be at least 13 years old to use Sparks. If you are under the age of majority in your jurisdiction, you may use the App only with permission from a parent or legal guardian.
You may use Sparks through an anonymous account or a registered account. You are responsible for maintaining the security of your login credentials and for activity that occurs under your account.
Sparks may offer one or more auto-renewing subscription plans or plan options shown inside the App at the time of purchase.
Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period. Your account may be charged for renewal within 24 hours before the end of the current period. You can manage or cancel subscriptions in your App Store account settings.
Pricing, billing periods, and available plans may change from time to time. The information shown in the App at the moment of purchase controls.
Purchases made through Apple are processed by Apple. Refund requests are handled according to Apple's policies and tools.
You keep ownership of the ideas, notes, and other content you create in Sparks ("User Content"). You give us a limited, non-exclusive license to host, process, store, and display that content only as needed to operate and improve the App for you.
You are responsible for the content you submit. Do not use Sparks to submit unlawful, abusive, infringing, or harmful content.
Sparks uses third-party AI services, including Google Gemini, to provide some optional creative assistance features. AI outputs are generated automatically and may be inaccurate, repetitive, incomplete, or similar to content provided to other users.
You are responsible for reviewing and deciding how to use AI-generated content. Sparks does not guarantee that AI output is original, commercially safe, legally clear, or fit for any particular purpose.
You agree not to:
Except for your User Content, the App, its code, design, text, branding, exercise structure, and related materials belong to Oleksandr Korzh or the relevant licensors and are protected by intellectual property laws.
You may stop using Sparks at any time. You may also request account deletion from within the App. If you request deletion, access to the account ends immediately and your data enters a deletion workflow described in the Privacy Policy.
Deleting your Sparks account does not cancel an Apple subscription. Subscription management and cancellation remain available through your Apple account settings.
We may suspend or terminate access to Sparks if you violate these Terms, misuse the service, create legal or security risk, or if we need to comply with law.
SPARKS IS PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR SUITABLE FOR YOUR PARTICULAR PURPOSE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, GOODWILL, OR BUSINESS OPPORTUNITY ARISING FROM OR RELATED TO YOUR USE OF SPARKS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO SPARKS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US THROUGH THE APP DURING THE 12 MONTHS BEFORE THE CLAIM; OR (B) USD 50.
These Terms are governed by the laws of Ukraine, without regard to conflict of laws principles.
If you download Sparks from the Apple App Store, your use of the App is also subject to Apple's standard Licensed Application End User License Agreement. Apple is not responsible for providing support or addressing claims relating to the App, except as required under applicable law and Apple's standard terms.
We may update these Terms from time to time. If we do, we will post the updated version and change the "Last updated" date above.
